동료에게 주는 햄버거에 치즈 한 장을 더 얹어줬다는 이유로 해고됐던

(be fired for giving a colleague an extra piece of cheese on a hamburger)

맥도널드 가게 여종업원이 나머지 고용 계약기간의 월급을 받게 됐다.

네덜란드 북부 리우바르덴의 지방법원(the district court in Leeuwarden, in the north of the Netherlands))은

26일(현지시각) “동료의 햄버거에 단지 치즈 한 장을 더 끼워줬는데(put just one more slice of cheese)

해고 조치(the dismissal)를 내린 것은 너무 지나치다(be too severe)”고 판결했다.

법원은 “서면 경고(a written warning)가 보다 적절한 처벌(a more appropriate punishment)이었을 것”이라며

“해고는 부당하므로 4265유로(약 690만원)에 달하는 나머지 고용 계약기간 5개월치 월급을 해당 근로자에게 지급하라

(pay the worker the salary for the remaining five months of her contract, a total of 4265 euros)”고 판시했다.

여종업원을 해고했던 가게는 법정비용도 지불하라는 명령을 받았다(be also ordered to pay court costs).

문제의 여종업원은 지난해 3월 휴식시간에(on a break)

동료가 지불한 가격의 햄버거 대신(instead of the hamburger she paid for)

더 비싼 치즈버거를 줬다는 이유로(for giving a colleague a more expensive cheese burger) 해고됐었다.

맥도널드는 이와 관련, 여종업원이 가족, 친구 또는 동료에게 어떤 무료 선물도 주지 못하도록 금지하고 있는

(prohibit any free gifts to family, friends or colleagues)

규정을 위반했기(break the rules) 때문에 해고는 정당하다고 주장해왔다.

이번 법원 판결은 맥도날드가 지난해 4분기에 25% 가까운 순익 증가를 기록했다고 발표한

(report an increase in net profits by almost 25 per cent in the last quarter of last year) 후 며칠 만에 나온 것이다.
